O Cientificismo Irracional Positivista: Uma ameaça às sociedades e às instituições – Davi Rocha de Jesus

1.0 Introdução

O positivismo apresenta diversas vertentes e não há como unificá-las em uma só, e também não há como apresentar uma crítica universal a todas elas. Dentre tantas linhas, poderíamos discorrer sobre as mais importantes, como o positivismo lógico de Rudolf Carnap, ou o positivismo jurídico de Hans Kelsen, mas o foco desse texto é o positivismo clássico de Auguste Comte e John Stuart Mill. Nesse ínterim, não há aqui o intuito de desqualificar totalmente os pensadores supracitados, principalmente John Stuart Mill, que promoveu grandes avanços em conhecimentos lógicos, econômicos e pragmáticos em seu tempo e a seu modo. O positivismo clássico é a vertente mais questionável e a mais difundida na sociedade ocidental, precipuamente no Brasil e na América Latina no geral. É importante salientar que a alcunha ‘positivista’ nem sempre detém o mesmo significado. Por exemplo: o utilitarismo positivista de John Stuart Mill é
diametralmente contrário ao positivismo jurídico de Hans Kelsen ou ao
juspositivismo em geral.

2.0 Positivismo Clássico

O Positivismo clássico difunde-se como um movimento revolucionário, anti-filosófico, anti-metafísico, anti-teológico e demasiadamente cientificista. Baseia-se na desconfiança para com o conhecimento filosófico e só valida como conhecimento verdadeiro aquilo que é “científico”, ou, mais
especificamente, aquilo que é uma ciência positiva ou dela deriva. “Em resumo, a filosofia teológica e a filosofia metafísica disputam entre si a tarefa, muito superior às forças de cada uma, de reorganizar a sociedade. Sob esse aspecto, só elas permanecem lutando. A filosofia positiva interveio atéagora na contestação apenas para criticar a ambas, e nisto se saiu suficientemente bem para desacreditá-las” Augusto Comte – Curso de Filosofia Positiva
Como se observa, o objetivo da “filosofia” positivista é extremamente paradoxal; sua “filosofia” consiste em negar a própria filosofia simpliciter em prol da ciência positiva. Trata-se de um sistema humanista de pensamento, limita o entendimento da realidade a sua forma mais pobre. Nega o
conhecimento entitativo e essencial da metafísica e da teologia e se aprofunda no conhecimento meramente fenomênico. A ciência positiva consiste na renúncia do conhecimento da natureza de seus objetos. Em suma, o fundamento do positivismo é a redução da capacidade epistêmica humana à mera apreensão de conexões interfenomênicas sem relação alguma com a entidade mesma das coisas. Não há aqui o intuito de desprezar as ciências positivas, mas de frisar que estas não são o único modo de conhecimento verdadeiro e justificado e que até mesmo as ciências positivas necessitam de princípios filosóficos.

3.0 Uma sociedade positiva e pobre de filosofia

Eis o retrato de nossa sociedade: uma comunidade que rejeita o pensamento filosófico e abraça a ciência meramente positiva. As consequências são avassaladoras, afetam desde o sistema educacional ao sistema jurídico, desde às normas de conduta até às atitudes cognitivas. Essa realidade gera o crescimento exponencial do utilitarismo nas relações sociais e do “racionalismo irracional” nas instituições governamentais. Aos que aderem ao positivismo, fatos científicos tornam-se ídolos e a filosofia torna-se uma mera especulação sem fundamento. Desse modo, eles bradam com orgulho que se baseam exclusivamente na “ciência”. “Por último, el positivismo ha dejado su huella en este género de sinonimias a través de la idea peyorativa que, respecto primero de la metafísica y mas tarde de la filosófia en general, estuvo en boga en el pasado siglo. Así, es frecuente utilizar el término “filosofía” para expresar todo lo que parece una “elucubración sin fundamento”, una “mera abstración”, o hasta una logomaqiua. 4.0 O positivismo institucionalizado no Estado e na Sociedade

A institucionalização do positivismo fez com que o pensamento científico passasse a ditar as regras da sociedade. Isso é, a legislação e as instituições dos países passaram a ser julgados por uma ciência extremamente racionalista – no sentido cartesiano. Esse fenômeno fez com que o Estado se tornasse uma entidade antropomórfica e gerou a crença de que tudo em um sistema social pode ser controlado e criado pela razão humana “consciente”. Nesse quesito, Friedrich Hayek com muita sabedoria demonstra que a antropomorfização do Estado e a racionalização cartesiana das normas institucionalizadas gerou enormes crises na humanidade. Essas crises ocorrem porque o Estado, constituído por seres humanos
limitados, não pode dominar todos os fatos, informações e conhecimentos objetivos, subjetivos e abstratos dispersos na sociedade. Os problemas centrais numa sociedade que se organiza dessa maneira é
o desprezo à espontaneidade dos agentes sociais, a superestimação do seu poder de previsão e a crença no domínio do conhecimento disperso na comunidade, gerando tentativas falhas de controlar os fenômenos sociais espontâneos. Esse comportamento de Estado acarreta em muitas crises econômicas por tentar impor intervenções triangulares ilícitas, pelas sucessivas tentativas de intervir nas relações individuais e privadas em larga escala. Além disso, ocorrem muitas crises jurídicas e institucionais pela fundamentação das normas positivadas meramente em fatos ditos científicos ou racionais – no sentido cartesiano -, que, inclusive, foi o que ocorreu com a Alemanha Nazista e com a União Soviética. O descaso pelas normas de conduta desenvolvidas espontânea, evolutiva e adaptativamente geram a desqualificação da tradição perpetrada pelos indivíduos em uma sociedade. Em consequência disso, realiza-se a substituição das normas de conduta pela institucionalização de normas conscientemente planejadas que ignoram toda a formação histórica e cultural da sociedade, seus princípios metafísicos e a decidibilidade de conflitos. É preciso ressaltar que não se nega que as legislações e instituições devem ser racionais, o que se defende aqui é que o que é verdadeiramente racional é o reconhecimento dos limites da razão consciente no armazenamento, entendimento e domínio de informações em uma ordem espontânea complexa. Além disso, a razão possui um poder inconsciente muito maior do que se imagina, nós somos seres que se adaptam de acordo com as interações sociais, nós somos “animais políticos”, tal como diz Aristóteles; e “animais gregários”, ou, mais especificamente, sociais, tal como afirma a tradição escolástica. E esse fenômeno é uma aptidão racional: os seres humanos enquanto indivíduos e agentes sociais se adaptam inconscientemente tanto à imprevisibilidade das ações de outros agentes quanto às expectativas mútuas implícitas de uma maneira extremamente eficaz. Sabe-se que a partir de experiências e fatos particulares, os indivíduos formam espontâneamente um conhecimento abstrato que é extraído de interações sociais comunicativas. Desses conhecimentos abstratos formam-se normas de conduta que passam a regular o comportamento, as interações e harmonizar as relações interpessoais. Existem milhares de normas de conduta e nenhuma entidade consciente poderia forçar uma adaptatividade tão eficiente. É preciso ressaltar que a análise consciente e a razão voluntária é essencial para a formação do Direito, mas deve-se ter em mente que os legisladores não podem criar normas a partir de dados científicos ou cálculos utilitaristas. Na verdade, o legislador deve encarar a sociedade como uma ordem
complexa espontânea, e o sistema jurídico deve ser encarado como um ordenamento dinâmico autopoiético e, desse modo, perceber que já existem inúmeras normas de conduta na sociedade, frutos de longos processos históricos, culturais, tradicionais e comunicativos. Através dessa percepção, o legislador irá selecionar as normas mais efetivas na decibilidade de conflitos, que são mais coerentes com o ordenamento
jurídico em geral e que correspondem aos princípios da razão prática.

5.0 Conclusão

A saúde de qualquer ordem complexa e espontânea depende da liberdade de seus elementos para seguirem o seu próprio curso de desenvolvimento. Isso não significa que a ordem é caótica: existem leis de ordenamento, porém tais leis não interferem no movimento livre de seus elementos, apenas conforma e harmoniza o movimento geral dos indivíduos do conjunto uns aos outros. Desse modo, quando um agente exógeno interfere no movimento natural e individual dos elementos tentando forçá-los a seguir para um resultado, obtém-se um caos; por outro lado, quando o sistema é visto como autopoiético e intra-ordenado e tudo que se faz é criar as condições propícias para à harmonização e à conformação dos elementos, cria-se uma ordem harmônica. E é assim que a sociedade funciona. Parafraseando Friedrich Hayek, o primeiro exemplo supracitado seria como um cientista que, visando formar um gelo, tentasse unir as moléculas de água líquida individualmente e unitariamente, interferindo nos movimentos
naturais a quais foram ordenados: tudo que ele conseguiria seria criar um caos ou apenas resultados nulos. Diferentemente, outro cientista apenas colocou a água em um congelador, criando as condições propícias para que o sistema por sua própria ordem e natureza fosse conduzido ao resultado desejado e, assim, obtendo êxito. Sendo assim, os que aderem ao positivismo em suas diversas faces, tentam e insistem em interferir na liberdade dos agentes sociais, em contradizer seu movimento livre e lícito, em ignorar o conhecimento disperso próprio do sistema, mas, no fim, tudo que fazem é gerar o caos.
